(Amended effective February 18, 2008)

 

WHEREAS, Hurst Creek Municipal Utility District (the "District"), of Travis County, Texas, owns, operates and maintains a water and sewer system designed to serve present and future inhabitants within the District; and

WHEREAS, the District has previously established fees, charges and conditions for service from the District's water and sewer system; and

WHEREAS, the Board of Directors has determined that the fees, charges and conditions for water and sewer service should be modified; NOW, THEREFORE,

BE IT ORDERED BY THE BOARD OF DIRECTORS OF HURST CREEK
MUNICIPAL UTILITY DISTRICT that the following fees, charges and conditions for receiving water and sewer service from the District are hereby adopted:

 

           

  I.   Treated Water  


A.

Tap Fees.  Prior to connection to the District's water system, the applicant must present evidence that the building permit from the Hills Property Owners Association (the "Hills P.O.A.) Architectural Committee has been received and shall pay the tap fees described below to the District to cover the cost of inspection or connection and the cost of providing the water meter.  No connections shall be covered in the ground until a representative of the District has inspected the connection.  Water tap fees, when paid, shall entitle the person paying the water tap fee to connect to the District's Water System during the ensuing six (6) month period.  Prior to the time that a certificate of occupancy for the house issued by the Hills P.O.A. Architectural Committee, water provided through the connection shall be used only for construction purposes and not for human consumption.  Consumption of water by humans prior to issuance of a certificate of occupancy shall constitute grounds for immediate disconnection of any tap made and discontinuance of service.

If, within the six (6) month period, the connection is not made or the facility being constructed is not certified for occupancy, then the District may disconnect and refuse to provide service.  In such event, no subsequent connection may be made without payment of the water tap fee then in effect.  The District may extend this six (6) month time period for exceptional  situations involving facilities which require more than six (6) months to construct provided that construction is proceeding diligently to completion.

B.
Drainage Fee
 
     
 
A $1,000 fee will be included with the tap permit fee obtained prior to new home construction to cover the costs of engineering review and inspection of drainage.
 
     
C.
Bimonthly Rates
 
     
 

After connection, the District shall charge the bimonthly rate to each metered unit regardless of water usage.

The charge for treated water per living unit equivalent (LUE), based on the City of Austin's LUE schedule, shall be as follows:

  II.   Sewer  

 

A.
Connections.  All connections to the District's sewer system shall be made in accordance with the District's "Rules and Regulations Governing Sewer House lines and Sewer Connections."  A sewer tap fee of $1,827.70 shall be charged for each connection made to the District's sewer system.  An additional charge will be made for larger connections.  Sewer tap fees, when paid, shall entitle the person paying the sewer tap fee to connect to the District's sewer system during the ensuing six (6) month period.  If, within that time, the connection is not made or facility being constructed is not certified for occupancy, then the District may disconnect any tap made and discontinue service or may refuse to provide service.  In such event, no subsequent connection may be made without payment of the sewer tap fee then in effect.  The District may extend this six (6) month time period for exceptional situations involving facilities which require more than six (6) months to construct provided that construction is proceeding diligently to completion.         
 
     

B.

Inspections. No sewer connection or house lead shall be covered in the ground before a representative of the District has inspected the connection (refer to the Order Establishing Rules and Regulations Governing Water and Sanitary Sewer Facilities).  The fee for the inspection will be $180.00 and will consist of rough, copper, plumbing top out, and final inspections.  Inspections for swimming pools will be $90.00, with an additional $90.00 if a backflow device is installed and an additional $90.00 if a propane tank is installed.  Inspections for sprinkler systems will be $90.00, All backflow devices must be tested by a State of Texas licensed tester and are not included with the sprinkler system and pool inspection fees.

 
     
C.
Bimonthly Rates.  After connection, sewer customers shall be billed bi-monthly.  Sewer charges shall be based on the water usage during December and January period, or calculated on actual water consumption each month if no winter month's consumption is available.

In the event that the customer had no recorded water usage for the previous December and January period, or any portion thereof, then the bi-monthly charge for sewer service shall be based on the actual water usage for that month not to exceed 6,000 gallons per month; provided, however, that the District may monitor the actual sewage flow from any customer and use the amount derived from such study to determine the monthly charge until the water usage data is available for the December and January period.

A surcharge may be levied depending on quality and quantity of waste.

 

      

  III.       Irrigation  

 

A.
Irrigation Water
 
 
1. Effluent Water:  Rater per 1,000 Gallons $0.88 per 1,000 gallons, based on actual amount of water used for the preceding month.  A monthly payment of $3,221 is required regardless of the actual amount of use during a month.

2, Raw Water: Rate per 1,000 Gallons.  Subject to the minimum charge in paragraph III.A.2., below, the District shall charge a rate of $1.13 per 1,000 gallons per month for raw water for irrigation purposes.
 
 
 

B.

Pressurized Raw Water.

1.  Monthly Minimum.  $25.00.

2.  In addition to the minimum charge in III.B.1. above, the District shall charge a rate of $1.13 per 1,000 gallons per month for pressurized raw water for irrigation purposes.

 

 

  IV.        Standby Fees  

 

The District does not impose a standby fee.

 

  V.        Late Payments  

 

 
A late payment charge of ten percent (10%) of the unpaid balance will be due the District for any bi-monthly bill which is not paid on or before the thirtieth (30th) day after the billing date.
 

        

  VI.       Termination of Service for Non-payment  

 

A.
The District reserves the right to terminate service to any customer whose account is delinquent in excess of thirty (30) days.  In such event, service shall be discontinued only after sending the customer written notice by first class United States mail and providing the customer with an opportunity to appear in person by written correspondence at a scheduled meeting of the Board of Directors to contest, explain, or correct the charges, services, or disconnection.  A customer's service shall not be disconnected if he/she has informed the District or the District's operator of his/her desire to contest or explain his/her bill.  If the customer appears before the Board, in person or by written correspondence, the Board shall hear and consider the matter and inform the customer of the Board's determination by sending written notice to the customer by first class United States mail stating whether the service will be continued or disconnected.  After final notice of termination has been sent to a customer, payment of the amount due on such customer's account must be in the form of cash, cashier's check, or money order.
 
     
B.
If service to a customer is disconnected for non-payment of a delinquent bill, a reconnection fee of $100 shall be collected before service is restored to the customer.  Payment of the reconnection fee must be in the form of cash, cashier's check, or money order.
 

       

  VII.      Returned Checks  

 

 
In the event that a customer's check is returned unpaid by the customer's bank because of insufficient funds, a charge of $25.00 shall be added to the customer's bill to cover the District's cost of handling.  If the customer's account is also more than thirty (30) days delinquent, the account shall be scheduled for termination and notice thereof shall be given as provided in Section VI above.  In such event, payment for the amount due on such account must be in the form of cash, cashier's check, or money order.
 

  

  VIII.     Trash Billing  

 

 
The District shall bill and collect bi-monthly garbage fees along with the water and sewer billings as set forth in the Order Approving Addition of Garbage Collection Charge to Water and Wastewater Bill, herein attached as an exhibit to this Rate Order.
 

 

  IX.       Miscellaneous Provisions  

 

A.
Within District.   The rates set out in this schedule apply only to service within the boundaries of the District.
 
     
B.
Future Adjustments.   The District reserves the right to adjust rates and fees from time-to-time when, in the opinion of the Board of Directors, such adjustments are required to meet the cost of administration, efficient operation, and adequate maintenance of the District's water supply, water distribution, and wastewater collection and treatment systems.
 
     
C.
No Free Service.  No free service shall be granted to any user for water and sewer services furnished by the District whether such user be a charitable or eleemosynary institution, a political subdivision, or a municipal corporation, and all charges for water and sewer shall be made as required herein.
 
     
D.
Effective Date.  This order is effective for all water and sewer services provided after February 18, 2008.
 

 

 

This Order supersedes all prior orders, resolutions, and other actions of the Board concerning fees and charges for water and sewer service.
